These General Terms and Conditions of Sale govern the relationship between Power Coin and the Customer in relation to the purchase of Products carried out remotely via electronic network on the website www.powercoin.it.

For matters not expressly provided, reference is made to the provisions of Legislative Decree 206/2005 (Consumer Code), Legislative Decree 70/2003 and the Civil Code.

1. Definitions

For the purposes of these General Terms and Conditions:

 - Distance Contract: the contract having as its object goods and/or services concluded between Power Coin and the Customer by means of distance communication tools.

 - Power Coin: Power Coin di Antonello Galletta, Via Appia Nuova 11 (Km 17.500), 00043 Ciampino (Rome), VAT No. 10265871003, Tax Code GLLNNL72H30H224H, REA CCIAA Rome No. 1225897.

 - Customer: the natural person acting for purposes unrelated to any entrepreneurial or professional activity possibly carried out.

 - Website: www.powercoin.it owned by Power Coin di Antonello Galletta, Via Appia Nuova 11 (Km 17.500), 00043 Ciampino (Rome).

 - Products: the goods sold by Power Coin indicated in the order confirmation and described for characteristics and quality on the website.

 - Parties: Power Coin and the Customer jointly.

 - Contract: the agreement governed by these General Terms and Conditions, concluded upon acceptance by Power Coin of the order confirmation sent by the Customer.

 - Order Confirmation: the acceptance by the Customer, transmitted electronically, of the sales conditions, prices, additional expenses and characteristics of the Products.

2. Contract

Receipt of the order confirmation by Power Coin does not constitute automatic acceptance of the same.

The order sent by the Customer constitutes a binding contractual proposal for the Customer. The Contract is considered concluded at the moment when Power Coin proceeds with the processing of the order and the sending of the related summary email containing the details of the purchase.

Upon conclusion of the Contract, Power Coin undertakes to deliver the Products according to the methods provided, without prejudice to the right to refuse or cancel the order in the cases provided for in these General Terms and Conditions of Sale.

Power Coin reserves in any case the right not to execute the order if:

 - the Customer does not provide sufficient guarantees of solvency;

 - the Product is unavailable;

 - there are material or technical errors relating to price or characteristics;

 - changes occur in the supply conditions by the Mint or the producer.

In such cases, the Customer’s sole right shall be the return of any amounts already paid.

3. Statements

The Products are described on the website accurately, according to the information provided by the Mints or official producers.

Power Coin does not guarantee the exact correspondence of the colors as displayed on the Customer’s monitor, nor the perfect fidelity of the images compared to the actual product.

The images may represent digital renderings, prototypes or official photographs provided by the Mints. The final product may present non-substantial variations.

The availability indicated on the Website has purely informative and non-binding value.

The Mints may at any time:

 - modify official prices;

 - reduce the allocated quantities;

 - postpone issue dates;

 - modify technical specifications;

 - cancel issues.

Such circumstances do not depend on Power Coin.

Power Coin reserves the right to cancel, suspend or modify an order already confirmed if:

 - the Mint does not supply the necessary quantities;

 - the Mint increases the price after publication or after the order;

 - material, technical or IT errors occur;

 - the published price proves to be manifestly incorrect.

In such cases, the Customer shall be entitled exclusively to the return of any amounts already paid. Alternatively, upon request of the Customer or upon proposal by Power Coin, a voucher of equal amount may be issued. In any case, no further indemnities, compensations or claims of any nature shall be due.

4. Payments

The published prices are subject to verification at the time of acceptance of the order.

In the event of an evident error or a subsequent variation of the supply price, Power Coin may:

 - propose the update of the price;

 - or cancel the order with full refund.

Payment must be made according to the methods indicated on the Website.

In the event of payment made through payment intermediaries (such as Stripe, PayPal or other similar providers), financial information is processed directly by the respective service providers, according to their contractual conditions and privacy policies, without Power Coin being able in any way to access, store or process such data.

5. Shipment

The delivery methods are indicated in the “Shipping” section on the website, which forms an integral part of these General Terms and Conditions.

The risk transfers to the Customer pursuant to Art. 63 of Legislative Decree 206/2005.

6. Complaints

7. Right of Withdrawal and Warranties

The Customer has the right to withdraw from the purchase within 14 days from receipt of the goods, except for the cases of exclusion provided for in these General Terms and Conditions of Sale.

To exercise the right of withdrawal, the Customer must:

 - send written communication via email to Power Coin expressing the intention to return the order;

 - wait for confirmation and operational instructions from Power Coin before proceeding with the return shipment;

 - return the Product within the indicated terms, bearing entirely the shipping, insurance and customs costs.

The Product must be returned:

 - intact;

 - unused;

 - in the original packaging;

 - complete with any accessories, certificates and documentation;

 - in conditions such as to allow its resale as new.

Once the goods have been received and the conformity of the return verified, Power Coin shall provide the refund of the amount due in accordance with applicable legislation. Alternatively, exclusively upon express request of the Customer, a voucher of an amount equal to the value of the returned goods may be issued.

Any additional costs (shipping, insurance, customs or additional services) are not refundable.

In the case of defective or damaged goods not attributable to the Customer, Power Coin shall, at its discretion, replace the Product (if available) or provide a full refund.

8. Pre-order products and order cancellation

Pre-order Products are not available at the time of the order. The issue date is indicative and may be subject to change.

Cancellation by the Customer entails a 5% retention with a 95% refund. Alternatively, if the Customer so wishes, a 100% value voucher may be issued.

Should the Mint modify price, quantity or supply conditions, Power Coin may cancel the order with full refund, without further obligations.

9. In stock products and order cancellation

If the Product is available but not yet shipped, cancellation by the Customer entails a 5% retention with a 95% refund. Alternatively, if the Customer so wishes, a 100% value voucher may be issued.

10. Voucher

Power Coin may issue:

 - vouchers in substitution of refund;

 - promotional vouchers.

Vouchers are not convertible into cash and are non-refundable.

Promotional vouchers constitute discretionary initiatives and may be suspended or revoked for justified reason.

11. Suspension and account closure

Power Coin may suspend or close the account in case of:

 - violation of these Conditions;

 - offensive or defamatory conduct;

 - abuse of promotions;

 - attempts of fraud;

 - repeated instrumental cancellations.

In serious cases, closure may occur without prior notice.

Any orders already paid and not yet fulfilled shall be refunded according to these General Terms and Conditions of Sale. Promotional vouchers not yet used may be cancelled.

12. Products Excluded from Withdrawal – Precious Metals

Pursuant to Art. 16(b) of Directive 2011/83/EU, the right of withdrawal does not apply to products whose price depends on fluctuations in the financial market not controllable by the seller.

Included in this category are:

 - bullion bars;

 - bullion coins;

 - products linked to the spot price;

 - precious metal products subject to market fluctuations.

13. Billing

The indicated prices are inclusive of VAT where applicable, or with VAT not shown as applied under the margin scheme pursuant to Art. 38, paragraph 1, first sentence of Legislative Decree 41/1995.

Power Coin shall regularize each sale through entry in the sales register or, if requested, by issuing an invoice.

14. Greater force

In the event of force majeure preventing, in whole or in part, the execution of the contract, the affected party shall notify the other party as soon as possible.

15. Legal Notes

For any dispute arising from the contract or related thereto, the court of residence or domicile of the Customer-consumer shall have jurisdiction.

16. Applicable law

The contract is governed exclusively by Italian law.

17. Acceptance of sales conditions

By submitting the order, the Customer declares that he/she has read and fully accepted these conditions of sale.

15. Passing the risk

The risk of loss or damage to the goods, for causes not attributable to Power Coin, transfers to the Customer-consumer only when the latter, or a third party designated by him/her other than the carrier, physically takes possession of the goods, pursuant to Art. 63 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

Pursuant to Art. 14 of Regulation (EU) No. 524/2013, Power Coin, owned by Antonello Galletta, informs the user who qualifies as a consumer pursuant to Art. 3, paragraph 1, letter a) of the Consumer Code that a European platform for online dispute resolution (ODR platform) has been established, available at the following address: http://ec.europa.eu/consumers/odr/ Through this platform, the consumer may consult the list of competent ADR bodies and initiate an alternative dispute resolution procedure.
